WORK IN USA TYPES OF USA WORK VISAS and PERMITS H1B - Specialty occupation Before filing for H1B application the H1B sponsor (employer) must obtain LCA (labor condition application ) approval notice. H-1B approval is employer-specific. A change of employer requires a new H-1B petition. The employer is responsible for return transportation costs for employee terminated prior to the end of the approved period of employment. H1B1 VISA The H1B1 category applies to specialty occupation which requires the theoretical and practical application of highly specialized knowledge. This requires 4 year degree or equivalent. (Eg: Engineering / software professionals) H1B2 VISA The H1B2 category applies to research and development project administered by the Department of Defense H1B3 VISA The H1B3 category applies to fashion models Documents required for H1B stamping Documents for H1B Stamping Each USA consulate is having different procedure to process NON Immigrant VISA. H1B approval notice (Form I797) LCA (Labor Condition Application) (copy) Letter from your H1B sponsor (Employer) Your employer should request the consulate general to issue an H1B VISA for you, with detailed company information, revenue, your job description and salary. Your degree and educational certificates (ALL) (Originals and copies of your school, high school, degree, diplomo marksheets and degree certificates) Experience letters from Current and previous employers. (If the experience letter from your current employer is NOT available, recent pay slips or employment offer letter will do) Passport Two photographs 1 and 1/2 inches square (37x37 mm) for each applicant VISA application form. - (Form DS-156) H1B Transfers H1B Visa Transfer - to change employers once you have an H1B visa. Current H1B visa holders can change and start work for a new employer as soon as an H1B transfer petition is 'submitted' to the USCIS by the new employer (new sponsor company). H1B transfers are Unlimited and NOT counted towards the annual cap (quota). this means H1B transfers can be filed at any time of the year. The H1B transfer bill approved in the senate and House now enables valid H1B visa holders to change jobs upon the filing of a new petition by the new employer as long as the individual is in lawful status at the time of filing and has not engaged in any unauthorized employment since his or her last lawful admission. Documents required for H1B Transfers Documents required for H1B Transfers You may be required to submit the following documents: · Recent Pay stubs up to 3 months latest pay . · Copy of your existing H1B approval. · Passport copies. · Copies of I-94 records. · Copy of Social Security Card. · Latest Resume. · Copy of existing valid visa. · Copy of all your educational qualifications Diploma and Degrees. Once your H1B transfer is submitted with the USCIS, it normally takes a few weeks, or in some case a little more time. The time varies depending upon the location of employment and the processing office. Facts to Know about H1B Transfers Facts to Know about H1B Transfers A person can have multiple H1Bs, but can work for only one company at a time A person can apply for H1B transfer through more than one company at the same time. Its not required to inform your current employer, and neither do they need to know about the transfer An I-94 is issued when you enter the USA, which contains a specific expiry date. A new I-94 can only be issued if the existing I-94 has expired. In case of H1B transfer, it is possible that your I-94 is still valid. H1B transfer is a separate process, and it has nothing to do with H1B cap. It is a transfer of your existing H1B approval to a new company and is not a ‘new’ H1B Once your H1B transfer is approved, there is no joining time limit. It is totally up to you, when you want to report to work for the new Company |
